The National Collective Labor Agreement in commercial sector, levels of classification and wages

The National Collective Labor Agreement in commercial sector is an agreement made by unions with employers in the commercial sector to regulate the duties and minimum rights of workers.

The National Collective Labor Agreement in commercial sector regulates the employment contracts, the performance of labor relations and their duration by defining national legislation.

What if the employment contract is regulated differently from The National Collective Labor Agreement or law?

National laws and regulations established by The National Collective Labor Agreement of a particular sector cannot be changed by an individual contract of an employee.

In the case of an individual agreement The National Collective Labor Agreement or national legislation shall prevail over what is written in the individual agreement.

One of the aspects regulated by The National Collective Labor Agreement is the minimum wage of an employee, which is related to the contractual level.

Employee duties are tasks that the employer assigns him during the day (for example, cleaning stores, customer service, coordinating the work of colleagues, etc.).

Tasks are divided into groups called levels.

In The National Collective Labor Agreement  in commercial sector, you can summarize them as follows:

  • First level: sector leaders;
  • Second level: employees who control or manage;
  • Third level: employees with specialized technical skills;
  • Fourth level: employees with sales responsibilities;
  • Fifth level: staff with good technical and practical knowledge.
  • Sixth level: workers with simple knowledge.
  • Seventh level: cleaners or similar duties.

Each level has a minimum monthly salary.

Payment of difference in case of incorrect determination of labor level

If the employee has the wrong level of labor classification, he may ask the employer to change (from the moment of hiring) the level in accordance with the actual tasks that he performs.

A new level of classification affects the minimum monthly wage.

If the minimum wage is not paid, the employee has the right to request a wage difference.
