What is asked in a labor dispute?

The subject of a labor dispute is the law associated with an employee and therefore with:

  1. beginning of an employment relationship, for example, confirmation of an employment contract;
  2. the development of an employment relationship, for example, the classification level (click here for more information) or an accident at work (click here for more information);
  3. the end of the employment relationship, for example, dismissal (click here for more information).

Union disputes: when do they take place?

Union disputes take place during or at the end of an employment relationship.

A union dispute at the end of an employment relationship is simpler because the employee no longer works for the employer and therefore does not obey him.

The validity period for the declaration of labor rights is related to the size of the employer staff and the declared right.

Here are some examples:

  • salary payment (for example, differences in wages for higher duties) by an employer with less than 15 employees. Validity period – 5 years from the end of the employment relationship or from the moment of the last request (request for payment);
  • salary payment if the employer has more than 15 employees. Validity period – 5 years from the moment of the salary payment or from the moment of the last request (request for payment);
  • dismissal; Worker has 60 days to appeal.

Labor disputes: how are they performed?

Labor disputes take place in three phases:

  • informed opinion: analysis of rights related to the dispute;
  • out-of-court stage: letter to the defendant;
  • judicial phase: appeal to a competent court for protection of rights.
